1. Acceptance of these terms

These Terms & Conditions ("Terms") are a legally binding agreement between you ("you", "user") and Bech ("Bech", "we", "us"). By creating an account, posting a listing, or otherwise using bech.pk or any Bech mobile application (the "Platform"), you accept these Terms and our Privacy Policy. If you do not agree, please do not use the Platform.

2. Eligibility

You must be at least eighteen (18) years of age and have the legal capacity to enter into contracts under the Contract Act, 1872. If you register on behalf of a business, you represent that you are authorised to bind that business.

3. Your account

• You must provide accurate information and keep it up to date.
• You are responsible for all activity under your account.
• Where we ask for identity verification (CNIC / KYC), you must provide truthful documents. Providing forged documents is an offence under Chapter XI of the Pakistan Penal Code, 1860 and may be reported to authorities.
• Keep your password confidential. Notify us immediately at security@bech.pk if you suspect unauthorised use.
• One person may only hold one account unless expressly permitted (e.g. verified dealer accounts).

4. Listings and user content

You may only list items or services that:

• You legally own or are authorised to sell.
• Comply with all applicable Pakistani laws, including but not limited to the Prevention of Electronic Crimes Act, 2016 ("PECA"), the Pakistan Telecommunication (Re-organization) Act, 1996, the Drug Regulatory Authority of Pakistan Act, 2012, and the Arms Ordinance, 1965.
• Do not infringe intellectual property rights of any third party.

The following listings are strictly prohibited and will be removed:

• Weapons, ammunition, explosives, and their components (except through licensed dealers with valid documentation).
• Narcotics, prescription-only medicines, and controlled substances.
• Counterfeit currency, forged documents, or fake identification.
• Live animals sold in violation of the Prevention of Cruelty to Animals Act, 1890 or provincial equivalents.
• Human organs, tissues, or blood.
• Adult, obscene, or blasphemous content (including material violating Section 295 of the Pakistan Penal Code).
• Stolen goods, or goods obtained through fraud.
• Items whose sale requires a licence you do not hold (alcohol, tobacco to minors, etc.).
• Multi-level marketing schemes, pyramid schemes, or "get rich quick" offers.

5. Bech is a platform, not a party to your transaction

Bech provides a listing and messaging platform. Any sale, purchase, barter or service arrangement is a private contract between the buyer and seller under the Contract Act, 1872 and the Sale of Goods Act, 1930. We are not the seller, buyer, agent, escrow, or courier for any transaction unless we explicitly state otherwise in writing.

You are solely responsible for verifying the item, negotiating the price, arranging inspection and delivery, and completing payment. We strongly recommend meeting in public places and inspecting the goods before paying.

6. Fees, paid features, and refunds

Creating a basic account and posting standard listings is free. Optional paid features — including but not limited to listing "boosts", featured placements, and dealer subscriptions — are governed by the pricing shown at the time of purchase.

• All fees are in Pakistani Rupees (PKR) unless stated otherwise.
• Applicable sales tax and provincial taxes may be added.
• Paid features are non-refundable once activated, except where required by law or where the feature demonstrably failed to deliver as described.
• Payments made through third-party gateways (banks, JazzCash, EasyPaisa, etc.) are also subject to those providers' terms.

7. Prohibited conduct

You agree not to:

• Harass, threaten, defame, dox, or blackmail other users (offences under Sections 20, 21, 24, and 25 of PECA, 2016).
• Send unsolicited bulk messages, spam, or malware.
• Access, scrape, or reverse-engineer the Platform, or attempt to bypass security controls (offences under Sections 3–6 of PECA, 2016).
• Impersonate any person or misrepresent your affiliation with any entity.
• Use the Platform for money laundering, tax evasion, or any activity prohibited by the Anti-Money Laundering Act, 2010.
• Circumvent the Platform's chat by trying to move buyers off-platform to avoid our safety features.
• Post the same or substantially similar listing more than once at a time.

8. Intellectual property

The Bech name, logo, design, software, and all Platform content (excluding user content) are the exclusive property of Bech and are protected under the Copyright Ordinance, 1962 and the Trademarks Ordinance, 2001. Nothing in these Terms grants you any right to use Bech branding without our prior written permission.

By posting content on Bech (photos, descriptions, chat messages, reviews) you retain ownership but grant Bech a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute that content to operate and promote the Platform.

9. Reporting problems

Every listing, user, and message has a "Report" option. Reports go to our moderation team. If you believe you are the victim of a cybercrime (fraud, harassment, unauthorised access), you may also file a complaint directly with the Federal Investigation Agency's National Response Centre for Cyber Crime (NR3C) at complaint.fia.gov.pk or by calling 1991.

10. Suspension and termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have breached these Terms, posted prohibited content, or used the Platform to defraud or harm others. Termination does not entitle you to a refund of any paid features already consumed.

You may close your account at any time from your profile settings. Some information may be retained after closure where the law requires it (see the Privacy Policy).

11. Disclaimers

The Platform is provided "as is" and "as available". We do not guarantee that listings are genuine, that sellers will honour their offers, or that the Platform will be uninterrupted or error-free. We do not endorse any user, listing, or transaction.

12. Limitation of liability

To the maximum extent permitted by Pakistani law, Bech, its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of the Platform, including loss of profit, loss of data, or loss of goodwill.

Our total aggregate liability to you in any twelve-month period shall not exceed the amount you paid to Bech during that period, or PKR 10,000, whichever is greater.

13. Indemnification

You agree to indemnify and hold Bech harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your user content, or your violation of any third party's rights.

14. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan. The courts at Islamabad shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that we may bring proceedings against you in any court of competent jurisdiction to protect our intellectual property.

15. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will change and, for material updates, we will notify you through the Platform or by email. Your continued use of the Platform after an update means you accept the revised Terms.
